Terms And Conditions - ‘Register To Win’ Competition

1. The Promoter is: Sound Australia (Qld) Pty Ltd (ABN 53 163 125 013), which has its registered office in Highvale Qld 4520.
2. Employees of Sound Australia (Qld) Pty Ltd (‘Sound Australia’), their family members, or anyone else connected in any way with the Competition or helping to set up the Competition shall not be permitted to enter the Competition.
3. Anyone who registers to receive email updates about Mackay Beach Horse Races 2022 via the Event Website (https://www.mackaybeachhorseraces.com.au) during the Competition Period (11 February 2022 to 14 March 2022) can enter the Competition by supplying the Competition entry information (name, post code and email address), agreeing to the Terms and Conditions, and agreeing to receive contact (including occasional promotional information) from Sound Australia (Qld) Pty Ltd (and its authorised representatives) by email. The Promoter has the right to disqualify any entrants or entries where the Promoter reasonably suspects any unlawful or improper conduct or a breach of the Terms and Conditions. 
4. Details of how to enter are:
   • Anyone who visits the Mackay Beach Horse Races 2022 site during the Competition Period can enter the Competition. 
   • No purchase is required. 
   • The personal information required to enter is: name, phone number, post code and email address. 
   • No entries will be accepted via phone, email, social media or in person.
5. No further entries to the Competition will be permitted after the end of the Competition Period.
6. No responsibility can be accepted for entries not processed for whatever reason.
7. All eligible entries in the competition received during the Competition Period will enter the Draw.
8. There is one major Prize which incorporates the following: 
   • 2 x adult General Admission Mackay Beach Horse Races 2022 season tickets; with
   • 2 x VIP upgrades.
9. The Promoter reserves the right to cancel or amend the Competition and these Terms and Conditions without notice in the event of a public health crisis, catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control. Any changes to the Competition will be notified to entrants by the Promoter as soon as possible.
10. The Promoter is not responsible for inaccurate prize details supplied to any entrant by any third-parties connected with this competition.
11. No cash alternative to the Prize will be offered. The Prize is not transferable. 
12. A Winner will be chosen by means of computerised random selection on 14 March 2022 at 12.00pm local time (AEST), at the Sound Australia (Qld) Pty Ltd offices by a staff member, contractor, or delegate of Sound Australia (Qld) Pty Ltd.
13. The Winner will be notified by email once selected. The Winner’s name may also be published on the Mackay Beach Horse Races Facebook Page and Instagram Feed. 
14. If the Winner cannot be contacted or does not claim the prize within seven (7) days of notification, The Promoter reserves the right to withdraw the prize from the Winner and select a replacement Winner from the remaining entrants in the same manner as the first Winner was selected.
15. The Promoter will notify the Winner of when and how the Prize can be collected.
16. The Promoter’s decision in respect of all matters to do with the Competition will be final and no correspondence will be entered into.
17. By entering this Competition, an entrant is responsible for all expenses that are incurred in entering the Competition and associated with use of the Prize; including but not limited to travel costs, parking, insurance, transfers, meals, spending money, and any other ancillary costs. 
18. Where a Prize includes a ticket, ticket allocation is at the Promoter’s sole discretion. Tickets may not, without the prior written consent of Promoter, be re-sold or offered for resale at a premium (including via online auction sites) or used for advertising, charity fundraising, promotion or other commercial purposes (including but not limited to competitions and trade promotions) or to enhance the demand for other goods or services, either by the winner/s or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled and the bearer of the ticket may be refused admission. The Promoter’s usual ticketing and venue terms and conditions apply to all tickets provided under this Promotion and by accepting tickets the Winner agrees to be bound by their respective terms, including any applicable age restrictions.
19. If the Winner of a Prize is under the age of 18 years, the Promoter may, at its discretion, award the Prize to the Winner's parent or guardian and/or the Promoter may require the Winner to be accompanied by a parent or guardian who will assume all responsibility for the Winner whilst participating in any element of the Prize and (if requested by the Promoter) will provide the Promoter with written confirmation to that effect.
20. The Promoter hereby expressly reserves the right to eject any Winner (and/or his/her companion/s) who in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or in an inappropriate manner whilst participating in any element of the Prize.
21. The Competition and these Terms and Conditions will be governed by Australian law and any disputes will be subject to the exclusive jurisdiction of the courts of Australia.
22. The Winner agrees to the use of their name on the Mackay Beach Horse Races Facebook Page and Instagram Feed. Any personal data relating to the Winner or any other entrants will not be disclosed to any third parties without the entrant’s prior consent.
23. Entry into the Competition will be deemed as acceptance of both the Competition Terms and Conditions, and the Event Terms and Conditions.
24. You are providing your information to Sound Australia (Qld) Pty Ltd only, and not to any other party. The information provided will be used in conjunction with the Australian Privacy Principles – the APPs – as set out in the Privacy Act 1988.
